These Terms of Use ("Terms") govern your access to and use of Fammetry's services, including our website at fammetry.com and our applications at admin.fammetry.app, app.fammetry.app, and kiosk.fammetry.app (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Fammetry, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to be bound by them. If you are using the Service on behalf of a family household, you represent that you have the authority to bind all household members to these Terms.
2. Description of Service
Fammetry is a family organisation platform that provides tools for managing household tasks, chores, grocery lists, calendars, timers, birthday reminders, and reward systems. The Service is intended for personal, non-commercial use by family households.
3. Account Registration
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use of your account.
You may not create accounts using automated means or create multiple accounts for the same household.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any commercial purpose without our written consent
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Upload or transmit any content that is unlawful, harmful, or offensive
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to store or transmit malicious code
- Violate any applicable laws or regulations
5. Children and Parental Responsibility
The Service is designed to be used by adults who manage household accounts on behalf of their family, including children. As the account holder, you are responsible for supervising your children's use of the Service and ensuring it is appropriate for their age.
You confirm that you are the parent or legal guardian of any child profiles you create within the Service, and that you consent to the collection and use of their information as described in our Privacy Policy.
6. Intellectual Property
The Service and all its content, features, and functionality — including but not limited to the software, design, text, graphics, logos, and icons — are owned by Fammetry and are protected by UK and international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create within the Service (tasks, events, grocery items, etc.). By using the Service, you grant us a limited licence to store and process that content solely to provide the Service to you.
7. Service Availability
We strive to provide a reliable service but do not guarantee uninterrupted or error-free availability. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
During the current free/beta period, the Service is provided "as is" without any uptime guarantee. When paid plans are introduced, service level commitments will be defined in a separate agreement.
8. Pricing and Payment
The Service is currently free for founding families during our early access period. We reserve the right to introduce paid plans in the future. We will provide at least 30 days' notice before any free tier is discontinued or restricted.
If and when paid plans are introduced, billing terms, refund policies, and cancellation procedures will be clearly communicated and will form part of these Terms.
9. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Fammetry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or £50 if you have not made any payments).
11. Indemnification
You agree to indemnify, defend, and hold harmless Fammetry and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may terminate your account at any time by contacting us at [email protected]. We will delete your account and associated data within 30 days of your request.
We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms or if we reasonably believe your use of the Service poses a risk to us or other users.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
For US users: to the extent any provision of these Terms conflicts with applicable US federal or state law, such law shall prevail for users in that jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
